TERMS AND CONDITIONS OF SALE AND DELIVERY

The below terms and conditions of sale and delivery apply to all supplies from Bøg Madsen A/S’ webshop, the HOUSE OF FLORA® shop. The terms and conditions apply only to private individuals as business operators should contact the HOUSE OF FLORA® shop on contact@houseofflora.dk regarding delivery.

Product information

The HOUSE OF FLORA® shop provides information about essential properties of the products. For additional information, please contact the HOUSE OF FLORA® shop at contact@houseofflora.dk.

Ordering

Generally, all the products shown in the HOUSE OF FLORA® shop are available from our stock. The HOUSE OF FLORA® shop points out that certain products may be out of stock and that delays may occur from suppliers. Reservations are therefore made for delivery of products advertised by the HOUSE OF FLORA® shop. If delivery cannot be made, you will be informed of this by e-mail within 1-3 business days. 

Products may be ordered only from the HOUSE OF FLORA® shop. All correspondence between you and the HOUSE OF FLORA® shop must take place via e-mail. In the days following your order, please check your e-mail since any delay in delivery will be announced by e-mail. The time of delivery from the time of dispatch from the HOUSE OF FLORA® shop corresponds to Post Danmark’s delivery time.

Once the HOUSE OF FLORA® shop has received your order, you will receive a receipt. You will receive an order confirmation by e-mail no later than at the time of dispatch from the HOUSE OF FLORA® shop. Please always check the order confirmation to ensure that everything is correct. If you have any questions, please contact the HOUSE OF FLORA® shop as quickly as possible. Please save your order confirmation in case of questions to the HOUSE OF FLORA® shop. Should you want to change or cancel an order, please contact the HOUSE OF FLORA® shop as quickly as possible.

Please remember to save the order confirmation which you will receive by e-mail immediately after the conclusion of the agreement.

Processing of personal data

The HOUSE OF FLORA® shop process personal data according to the Danish Act on Processing of Personal Data. If you want information about the type of information processed about you, or you want the information to be deleted or corrected, please contact the HOUSE OF FLORA® shop.

Prices and delivery


All the HOUSE OF FLORA® shop prices include 25% VAT.

The HOUSE OF FLORA® shop can accept no responsibility for price changes due to factors outside the control of the HOUSE OF FLORA® shop, including, but not limited to, changes in product prices introduced by the HOUSE OF FLORA® shop’s suppliers, new price or tax legislation, increases in postage and transportation costs and cost increases.

The product will be delivered directly to address stated by you or to the nearest post office. The HOUSE OF FLORA® shop uses Post Danmark. The postage costs depend on the weight of your order. These costs will appear from your order at the webshop where you can monitor the price all the time as well as all the costs connected with delivery, etc.
 
The HOUSE OF FLORA® shop will usually dispatch your products within 3-5 business days of the placing of your order. The order confirmation states when the product has been dispatched from the HOUSE OF FLORA® shop’s warehouse.

Products to be delivered in Denmark will be delivered by Post Danmark. Payment will be deducted from your account when the product ordered is dispatched to you.

For products to be delivered to EU countries, the price will include Danish VAT. For countries outside the EU (including the Faroe Islands and Greenland), the products will be delivered exclusive of Danish VAT.

A handling fee is added for shipment abroad to cover the extra costs of paper work and payment transfer fees.

Delivery costs to non-EU countries include a customs clearance fee per package (maximum 20 kg per package). This customs clearance fee will be deducted from your account when the product ordered is dispatched to you.

You must check the product upon receipt, and, in particular, whether damaged packing indicates that the product may have been damaged. If the packaging is damaged, you should reject the delivery. If delivery of the product is accepted, any subsequent claims for damage in transit will be invalidated.

Right of cancellation and return

Under Danish law, you are entitled to cancel your purchase and return the product no later than fourteen (14) after having received the product.

If you return the product, it must be in the same condition and quantity as when received. Whenever possible, the product must be returned in its original packaging. The innermost packaging must be unopened. The part of the outer packaging opened must also be returned. A copy of the order confirmation must also be included.

When returning products, please use Post Danmark. The product should be returned properly packed, enclosing a copy of the order confirmation. Please state clearly that you wish to exercise your right to cancel the purchase and obtain a refund.

You can also cancel your purchase by refusing to accept the delivery.

You must pay the costs of returning the product. If the product meets the requirements concerning right of cancellation and return, you will be refunded no later than thirty (30) days after the HOUSE OF FLORA® shop has received the product. The amount to be refunded includes both the price paid for the relevant product and any delivery costs.

Obligation to examine

Immediately upon receipt, you must examine the supply thoroughly to make sure that the product is faultless and delivered according to contract. If, at this time, you believe that the product sold has a defect, you must immediately inform the HOUSE OF FLORA® shop in writing about this if you want to claim for defects.

Payment and receipt

You can pay using Dankort (Danish debit card), Visa/Dankort (Danish/international debit card) or the following foreign debit cards: MasterCard and Visa over an encrypted secure connection directly from you to quickpay.dk which carries out the payment.

When you order by debit card, you will be prompted to enter your card number, card expiry date and card security code. It is free to use a debit card as the HOUSE OF FLORA® shop pays all the associated fees. The payment for your order will be deducted from your account when the product is dispatched from the HOUSE OF FLORA® shop.

The account information you enter when purchasing products will be sent directly to Danish Payment Systems (PBS) in an encrypted form.  The HOUSE OF FLORA® shop uses SSL (Secure Socket Layer) which is a protocol for secure transfer of data over the Internet. This means that no-one else will see the information about you.

Complaints


You have a two-year right of complaint covering all products. Any defects concerning the product delivered must be reported within a reasonable time after you have or should have discovered the defect. The right of complaint does not cover defects, damage or wear and tear directly or indirectly caused by misuse, poor maintenance, unauthorised tampering, etc.

In the case of any complaint, the order confirmation must be presented to the HOUSE OF FLORA® shop. Please state and, on demand, present the defect.

Limitation of liability, guarantee and reservations

Through links, the HOUSE OF FLORA® shop has made it easy for you to obtain relevant information from other websites. These websites are outside the control of the HOUSE OF FLORA® shop and the shop can therefore not in any way be held liable for their content. Information on the products ordered from such websites is not included in the description of the products covered by the agreement between you and the HOUSE OF FLORA® shop.

The HOUSE OF FLORA® shop cannot be held liable for direct or indirect losses as a consequence of late delivery of the ordered products to you, or defects in the ordered products, when such delays or defects are due to your act or omissions, or are caused by circumstances outside the control of the HOUSE OF FLORA® shop, including, but not limited to, war, riot, civil commotion, fire, action by the state, seizure, currency restrictions, labour disputes of any kind, including strike and lockout.

The HOUSE OF FLORA® shop offers no independent guarantee for the products ordered, and you only have the guarantees provided by the producer to you.

The HOUSE OF FLORA® shop cannot accept responsibility for misprints concerning prices or product descriptions.

Alterations


The HOUSE OF FLORA® shop reserves the right to alter and update the rules and conditions that apply to this website. It is therefore important that you keep yourself informed concerning alterations.

Disputes

Disputes arising out of agreements between you and the HOUSE OF FLORA® shop must be settled according to Danish law at the venue of the HOUSE OF FLORA® shop which is the Court of Odense.
